Terms of Service

Effective date: June 1, 2026

These Terms of Service ("Terms") govern your access to and use of Sunlight, a privacy-first parental control and mobile device management (MDM) platform for Apple devices, operated by Sunlight Speed Inc ("we," "us," or "our"). By creating an account or using the Service you agree to these Terms. If you are entering into these Terms on behalf of an organization, you represent that you have authority to bind that organization.

1. Service Description

Sunlight provides parental control and device management capabilities for iPhone, iPad, and Mac using Apple's native MDM framework and Screen Time APIs. The Service may include content filtering, app access controls, screen time scheduling, and administrative reporting.

Sunlight is currently in a private beta and is being developed for several use cases, including Family, Schools, Churches, Organizations, and Business. Features available to your account may change with notice as the Service evolves.

2. Accounts and Eligibility

You must be at least 18 years old to create an account. Account administrators are responsible for all activity that occurs under their account and must keep credentials confidential. You agree to provide accurate registration information and to update it as needed.

You may only enroll devices that you own or for which you have lawful authority to manage (e.g., as a parent, legal guardian, employer, or authorized school administrator). You are responsible for ensuring that any person whose device is managed has been informed of that management in accordance with applicable law.

3. Children's Privacy and COPPA

Sunlight's Family use case is designed to be used by parents and legal guardians to manage devices used by minors. We comply with the Children's Online Privacy Protection Act (COPPA). We do not knowingly collect personal information directly from children under 13 without verifiable parental consent.

When you enroll a child's device under a Family account, you represent that you are the child's parent or legal guardian and that you consent to the limited operational data we collect to provide the Service. For details on what data is collected, see our Privacy Policy.

Parents may review, correct, or delete any data associated with their child's enrolled device by contacting us at legal@sunlightspeed.com.

4. Schools Use: FERPA and CIPA

School customers are solely responsible for obtaining any required student or parent consents and for ensuring their use of the Service complies with the Family Educational Rights and Privacy Act (FERPA) and the Children's Internet Protection Act (CIPA).

We act as a "school official" under FERPA to the limited extent necessary to provide the contracted Service. We do not use student data for any purpose beyond providing, maintaining, and improving the Service as directed by the school. Student data is not sold, shared with advertisers, or used for behavioral profiling.

5. Data Rights (GDPR / CCPA)

Depending on where you live, you may have rights regarding personal data we hold about you, including:

  • Access — request a copy of the personal data we hold about you.
  • Deletion — request erasure of your personal data, subject to legal retention requirements.
  • Portability — receive your data in a machine-readable format.
  • Correction — update inaccurate personal data.
  • Opt-out of sale — we do not sell personal data; no opt-out is needed, but you may confirm this in writing.

6. Acceptable Use

You agree not to use the Service to:

  • Enroll devices you do not own or are not authorized to manage.
  • Conduct unauthorized surveillance of adults without their knowledge and consent.
  • Attempt to reverse-engineer, decompile, or tamper with any part of the Service.
  • Resell or sublicense the Service without our written permission.
  • Violate any applicable law, regulation, or third-party right.

7. Device Management Scope

Sunlight uses Apple's MDM framework to apply configuration profiles, enforce content policies, and manage app access on enrolled devices. To be transparent about the scope of management:

What Sunlight can do

  • Apply content and app filtering policies
  • Enforce screen time and downtime schedules
  • Restrict or allow specific app categories
  • Send MDM commands (e.g., lock, wipe) where authorized
  • Deliver configuration profiles

What Sunlight cannot do

  • Read messages, emails, or app content
  • Access the camera or microphone
  • Track real-time location
  • Log browsing history, URLs, or individual domain queries
  • Intercept encrypted communications

Privacy commitment: We do not log browsing history, URLs, or individual domain queries. Filtering decisions happen on the device or at the network level without transmitting personal browsing data to our servers.

8. Intellectual Property

The Service and all related software, logos, and content are owned by Sunlight Speed Inc or its licensors and are protected by intellectual property law. These Terms do not grant you any right to use our trademarks or branding. You retain ownership of any data you provide; you grant us a limited license to use that data solely to provide the Service.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, UNINTERRUPTED, OR THAT ANY CONTENT FILTERING POLICY WILL BLOCK ALL OBJECTIONABLE MATERIAL.

Content filtering is a tool to assist parents and administrators — it is not a substitute for parental supervision or school policy enforcement. No filtering technology is 100% effective.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SUNLIGHT SPEED INC'S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE IS LIMITED TO ONE HUNDRED U.S. DOLLARS ($100). IN NO EVENT WILL WE BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

11. Dispute Resolution and Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-law provisions. Before filing any legal action, you agree to first contact us at legal@sunlightspeed.com and give us 30 days to attempt to resolve the dispute informally.

If informal resolution fails, disputes will be resolved by binding arbitration under the AAA Consumer Arbitration Rules, except that either party may seek injunctive or other equitable relief in a court of competent jurisdiction. You waive any right to participate in a class action lawsuit or class-wide arbitration. This arbitration clause does not apply to School customers with a separately executed service agreement.

12. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the effective date at the top of this page and, for material changes, notify account administrators by email at least 14 days before the change takes effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
